Summary: With the transposition in 2004 of the 1995 European directive on personal data, the French data commission (CNIL) now holds additional powers to conduct compliance controls and to impose sanctions on the persons responsible for the data treatments in cases of non compliance with the provisions of the French data protection act. The CNIL has decided to increase such controls using other administrative bodies : DGCCRF (Consumer protection and anti-fraud administration) and ARJEL (Authority regulating online gambling).Article en version pdf

How can their owners challenge the suspension of non-authorized gambling web sites by ARJEL? (co-written with Betty Sfez, published on Le Journal du Net)
Summary: ARJEL, the French authority regulating online gambling, was created with the Law of May 12, 2010 regarding the opening of gambling web sites to competition. This Authority is in charge of granting authorizations to the owners of on line gambling web sites and of pursuing illegal gambling sites. This task also includes the ability to request the President of the Civil court to decide to suspend access to illegal gambling sites accessible on the French territory. This judicial procedure, which does not include the owner of the alleged illegal web site, was recently declared legal by the Paris Court of Appeals.Article en version pdf

The rules prohibiting on-line advertising for alcoholic beverages, which had been under intensive criticism following the 2008 Heineken court decisions, have been modified.
